1. Agreement to Terms

By accessing or using the Ethos Aloft website (ethosaloft.com), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website.

"Ethos Aloft" refers to UniquelyBehaved LLC, its owners, employees, contractors, and affiliates.

2. Services Description

Ethos Aloft provides neurodiversity cabin support and crew training for private and corporate aviation, including:

Cabin support on private and corporate flights carrying a neurodivergent traveler
Neurodivergent-passenger training for an operator's or flight department's flight attendant corps

Ethos Aloft provides cabin support and training — not clinical, counseling, or behavior-analytic services.

2.1 Service Agreements

Specific services are provided under separate Statements of Work (SOW) or Service Agreements that detail scope, deliverables, timelines, and fees. These Terms govern general use of our website.

2.2 What We Do Not Provide

We are not a law firm, medical provider or regulatory authority, and nothing we provide is legal, medical or regulatory advice.

3. Website Use

3.1 Permitted Use

You may use our website for lawful purposes related to learning about our services, contacting us for inquiries, subscribing to our newsletter, downloading resources, and scheduling consultations.

3.2 Prohibited Use

You may not:

Use the website for unlawful purposes
Attempt to gain unauthorized access to our systems
Interfere with website operation or security
Scrape, copy, or republish our content without permission
Use automated systems to access our website (except search engines)
Impersonate Ethos Aloft or our personnel
Submit false or misleading information

4. Intellectual Property

4.1 Our Content

All content on this website is owned by Ethos Aloft or licensed to us, including text, graphics, logos, images, training materials and curriculum, assessment frameworks and methodologies, resources and downloadable materials, and website design and code. This content is protected by copyright, trademark, and other intellectual property laws.

4.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and view website content for personal, non-commercial use, download resources we make available, and print materials for personal reference. You may not reproduce, distribute, publicly display, modify, create derivative works, or use content for commercial purposes without permission.

4.3 Client Materials

Ownership of, and rights to use, materials created for an engagement are set by the signed agreement for that engagement.

5. Service Terms

Where you and UniquelyBehaved LLC have signed a separate written agreement, that agreement governs on its subject, and these Terms do not supply, add to or change any of its terms.

Fees, payment, expenses and cancellation for each engagement are set by the signed agreement for that engagement. These Terms do not set any of them.

6. Disclaimers

6.1 No Guarantees

We do not guarantee any particular outcome from any service.

6.2 Professional Advice Disclaimer

Content on this website is general information. It is not legal, medical or regulatory advice, and it is not a certification that any operator, program or person complies with any law or regulation.

7. Limitation of Liability

7.1 Nothing limits our responsibility if someone is hurt. Nothing in these Terms limits or excludes our liability for: (a) death or bodily injury; (b) abuse, molestation or sexual misconduct; (c) a failure of safeguarding or supervision of a passenger, whether or not bodily injury results; (d) gross negligence, willful misconduct or fraud; (e) a breach of any law protecting personal information; or (f) any other liability that cannot be limited or excluded under applicable law.

7.2 Website use. Subject to Section 7.1, our total liability to you arising out of your use of this website is limited to $100, and we are not liable to you for indirect or consequential loss arising out of your use of this website.

7.3 Services. These Terms do not limit liability for any service we provide. Liability for a service is set by the signed agreement for that engagement, and nothing in these Terms limits or releases any claim of a passenger or of anyone under 18.

8. Misuse of This Website

If you use this website in breach of Section 3.2, you are responsible for the loss your breach causes us, to the extent the law makes you responsible for it. This Section does not apply to any service we provide, to a passenger, or to anyone under 18.

9. Confidentiality

Confidentiality for an engagement is set by the signed agreement, and any non-disclosure agreement, for that engagement. These Terms do not set it.

10. Privacy

How we collect, use and protect personal information is described in our Privacy Policy at ethosaloft.com/privacy.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You and we submit to the non-exclusive jurisdiction of the state and federal courts sitting in Florida for any dispute arising out of these Terms. Nothing in these Terms requires arbitration, mediation or any other step before a claim is brought, prevents a claim in a small-claims court of competent jurisdiction, or waives any right you have under the law of your own state of residence. A dispute about a service is resolved under the signed agreement for that engagement.

12. General Provisions

Entire Agreement: These Terms are the entire agreement between you and us about your use of this website. They do not form part of any signed agreement.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

Waiver: Failure to enforce any provision does not constitute waiver.

Assignment: You may not assign your rights under these Terms. We may assign our rights to a successor in interest.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated by posting updated Terms on our website and updating the "Last Updated" date. Continued use after changes constitutes acceptance of modified Terms.
