    1. Agreement to Terms

    By accessing or using the Ethos Aloft website (ethosaloft.com) and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.

    "Ethos Aloft" refers to UniquelyBehaved LLC, its owners, employees, contractors, and affiliates.

    2. Services Description

    Ethos Aloft provides neurodiversity cabin support and crew training for private and corporate aviation, including:

    • Cabin support on private and corporate flights carrying a neurodivergent traveler
    • Neurodivergent-passenger training for an operator's or flight department's flight attendant corps
    • Course content and trainer preparation for training providers

    Ethos Aloft provides cabin support and training — not clinical, counseling, or behavior-analytic services.

    2.1 Service Agreements

    Specific services are provided under separate Statements of Work (SOW) or Service Agreements that detail scope, deliverables, timelines, and fees. These Terms govern general use of our website and baseline service terms.

    2.2 Professional Services

    Our services constitute professional consulting advice. We are not a law firm, medical provider, or regulatory authority. Our recommendations should be evaluated in the context of your specific situation and, where appropriate, reviewed by qualified legal, medical, or regulatory professionals.

    3. Website Use

    3.1 Permitted Use

    You may use our website for lawful purposes related to learning about our services, contacting us for inquiries, subscribing to our newsletter, downloading resources, and scheduling consultations.

    3.2 Prohibited Use

    You may not:

    • Use the website for unlawful purposes
    • Attempt to gain unauthorized access to our systems
    • Interfere with website operation or security

    4.2 Limited License

    We grant you a limited, non-exclusive, non-transferable license to access and view website content for personal, non-commercial use, download resources we make available, and print materials for personal reference. You may not reproduce, distribute, publicly display, modify, create derivative works, or use content for commercial purposes without permission.

    4.3 Client Materials

    For materials created under service agreements: Ethos Aloft retains ownership of underlying methodologies, frameworks, and intellectual property. Clients receive license to use deliverables for internal purposes as specified in service agreements.

    5. Service Terms

    5.1 Payment Terms

    Unless otherwise specified in a Service Agreement:

    • Payment terms: 50% upon agreement, 50% upon completion
    • Invoices due within 30 days
    • Late payments subject to 1.5% monthly interest
    • Travel and expenses billed at cost with receipts

    5.2 Cancellation

    • Cancellations with 30+ days notice: Full refund of unused fees
    • Cancellations with 14-30 days notice: 50% refund of unused fees
    • Cancellations with less than 14 days notice: No refund
    • Work completed to date is billable regardless of cancellation

    6. Disclaimers

    6.1 No Guarantees

    While we strive for excellence, we cannot guarantee specific outcomes from our services. Results depend on client implementation quality, organizational commitment, market conditions, regulatory changes, and factors outside our control. Projected outcomes, case studies, and ROI estimates are based on industry benchmarks and research; actual results may vary.

    6.2 Professional Advice Disclaimer

    Our services provide consulting advice based on our expertise in autism and aviation accessibility. This is not legal advice (consult an attorney), medical advice (consult healthcare providers), or regulatory compliance certification (consult regulators).

    7. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW:

    • Our total liability for any claim arising from services shall not exceed the fees paid for those services
    • Our total liability for website use shall not exceed $100
    • We are not liable for indirect, incidental, special, consequential, or punitive damages
    • We are not liable for lost profits, data, or business opportunities

    These limitations do not apply to liability that cannot be excluded by law, gross negligence or willful misconduct, or fraud or misrepresentation.

    8. Indemnification

    You agree to indemnify, defend, and hold harmless Ethos Aloft, its owners, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of our website or services, your violation of these Terms, your violation of any third-party rights, or your misuse of materials or deliverables.

    9. Confidentiality

    Both parties agree to maintain confidentiality of non-public information shared during the engagement, including business strategies and plans, financial information, client data and passenger information, proprietary methodologies, and trade secrets. Confidentiality obligations do not apply to information that is or becomes publicly available, was known prior to disclosure, is independently developed, or is required to be disclosed by law. Confidentiality obligations survive termination of services for three (3) years.

    10. Privacy

    Our collection and use of personal information is governed by our Privacy Policy, available at ethosaloft.com/privacy. By using our website and services, you consent to our Privacy Policy.

    11. Governing Law and Disputes

    These Terms are governed by the laws of the State of Florida, without regard to conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved through: (1) informal good-faith resolution within 30 days, (2) mediation if unresolved, and (3) litigation in courts of Florida if mediation fails. You consent to exclusive jurisdiction of courts in Florida for any disputes.

    12. General Provisions

    Entire Agreement: These Terms, together with our Privacy Policy and any Service Agreements, constitute the entire agreement between you and Ethos Aloft.

    Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

    Waiver: Failure to enforce any provision does not constitute waiver.

    Assignment: You may not assign your rights under these Terms. We may assign our rights to a successor in interest.

    13. Changes to Terms

    We may modify these Terms at any time. Material changes will be communicated by posting updated Terms on our website and updating the "Last Updated" date. Continued use after changes constitutes acceptance of modified Terms.
